RESIDENCY
The party
filing for dissolution must have been a resident of Illinois for
90 days immediately prior to filing for dissolution of marriage.
GROUNDS
No-Fault:
Irreconcilable differences has caused the irretrievable breakdown
of the marriage and reconciliation has failed or further attempts
at reconciliation are impractical and the spouses have been living
separate and apart without cohabitation for 2 years. (If both spouses
consent, the time period becomes 6 months).
Impotence;
Adultery;
Habitual
drunkenness for 2 years and/or drug addiction;
Conviction
of a felony;
Willful
desertion for 1 year;
Cruel and
inhuman treatment;
Attempted
poisoning or otherwise endangering the life of the spouse;
Infection
of the other spouse with a communicable disease;
Bigamy.
We include
the waiver for the two year separation requirement.
LEGAL
SEPARATION:
Parties
may file for a Legal Separation in Illinois under the grounds of:No
Fault
PROPERTY
DISTRIBUTION:
The parties
can decide how to divide the marital property by signing and executing
a Marital Settlement Agreement, otherwise the court will decide
based on equitible distribution.
CHILD
ISSUES
Parties
can agree on custody of the minor children, either sole custody
or joint custody. If the parties cannot agree, the court will decide
what is in the best interest of the children.
If the parties
agree to joint custody, they will need to sign and execute a Joint
Parenting Plan.
Parties
can agree on child support. If the parties cannot agree on an amount
of child support, the court will decide using the Illinois child
support guidelines. Support will be calculated using both parties
incomes, child care costs, health and dental insurance costs, and
any other child expense.
