Residency
Either party must be
a resident of Iowa for one year.
Grounds for Filing:
The Petition for Dissolution
of Marriage must state the appropriate grounds upon which the dissolution
of marriage is being sought.
No-Fault: Allege that
there has been a breakdown of the marriage relationship to the extent
that the legitimate objects of matrimony have been destroyed and
there remains no reasonable likelihood that the marriage can be
preserved.
A Final Decree will not
be granted until at least 90 days from the date the divorce is filed.
PROPERTY DISTRIBUTION:
The parties can agree
and sign and execute a Marital Settlement Agreement. If the parties
cannot agree on property division, the court will decide based on
equitible distribution laws.
CHILD ISSUES
Parties can agree on
joint custody or sole custody. If parties cannot agree, the court
will decide based on the best interest of the children.
Parties can agree on
child support. If the parties cannot agree then the court will decide
based on the Iowa child support guidlines. The court will factor
in both parties incomes, child care costs, health and dental insurance,
and any other child related expenses.
