RESIDENCY:
Either spouse
must be a resident and have been a resident for at least 180 days
prior to the divorce filing.
A Decree
of Dissolution will not be granted until the spouses have resided
apart for a period of 60 days. Parties can reside in the same home
as long as they are not sharing a bed.
GROUNDS
Irretrievable
breakdown of the marriage (no fault).
LEGAL
SEPARATION:
Spouses
may file for a legal separation. Irretrivable breakdown is the only
ground for legal separation.
SIMPLIFIED
DIVORCE
Parties
may sign and execute a Marital Settlement Agreement.
PROPERTY
DISTRIBUTION:
Marital
property is divided using equitibule distribution.
CHILD
ISSUES
Parites
may agree to sole or joint custody of the minor children. If parties
cannot agree, the court will decide what is in the best interest
of the minor children.
If the parties
cannot agree on child support, the court will order support according
to the Kentucky child support guidelines.
