RESIDENCY

One of the spouses must be and have been a resident of Michigan for 180 days and a resident of the county where the divorce is filed for at least 10 days.

Special Circumstances: Plaintiff may file for divorce in any county in the state without meeting the 10-day residency requirement if the defendant was born in or is a citizen of a foreign country and there are minor children in the marriage that are at risk of being taken out of the country by the defendant.

GROUNDS

No-Fault: A breakdown of the marriage relationship to the extent that the objects of matrimony have been destroyed and there remains no reasonable likelihood that the marriage can be preserved.

LEGAL SEPARATION:

Parties may file for a legal separation if there is a breakdown of the marriage relationship to the extent that the objects of matrimony have been destroyed and there remains no reasonable likelihood that the marriage can be preserved. There is no residency requirement specified in the statute.

SIMPLIFIED DIVORCE:

Both parties may file for a divorce and sign a Marital Settlement Agreement.

PROPERTY DISTRIBUTION:

If the parties cannot agree on property division, the court will decide based on equitible distribution.

The parties can agree and sign a Marital Settlement Agreement which will stipulate how the marital property shall be divided.

CHILD ISSUES

Parties can agree on child custody, either sole custody or joint custody. If the parties cannot agree, the court will decide what is in the best interest of the minor children.

Parties must attend a parenting class through the court.

Parties may agree on child support. If they cannot agree on child support, the court will decide using the Michigani child support guidelines. The court will calculate child support and include costs for heath and dental insurance, child care, and extraordinary needs for the children.
